1. Acceptance of Terms
By accessing or using ShopQ ("the Platform"), operated by PulseCommerce Private Limited ("we", "us", or "the Company"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding contract under Indian law. By using ShopQ, you represent that you meet these requirements.
3. Account Registration
You must provide a valid Indian mobile number to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.
4. Platform Services
ShopQ provides a marketplace platform connecting buyers, sellers, service providers, and delivery partners. We facilitate transactions but are not a party to the sale agreement between buyers and sellers unless explicitly stated.
5. Listing and Selling
Sellers must provide accurate descriptions and images of items. Prohibited items include but are not limited to: illegal goods, counterfeit products, hazardous materials, weapons, and items that violate intellectual property rights. We reserve the right to remove any listing without notice.
6. Bidding and Auctions
Bids placed on the Platform are binding. The highest bidder at auction close is obligated to complete the purchase. ShopQ reserves the right to cancel auctions that violate our policies or where fraud is suspected.
7. Payments and Escrow
Payments are processed through our authorized payment partners (Razorpay, UPI via Juspay). Funds are held in escrow until the buyer confirms receipt or the return window expires. ShopQ charges a platform fee on completed transactions as disclosed at the time of listing.
8. Delivery
Delivery is facilitated through ShopQ riders or self-pickup. Estimated delivery times are indicative and not guaranteed. Risk of loss passes to the buyer upon delivery confirmation.
9. Returns and Refunds
Return and refund policies vary by listing type. Buyers may request returns within the applicable return window. Refunds are processed to the original payment method within 5-7 business days of approval.
10. KYC and Verification
Partners, sellers, and riders must complete identity verification (KYC) as required. We use Aadhaar-based verification and phone number validation. Failure to complete KYC may result in account suspension.
11. Intellectual Property
All content, trademarks, and intellectual property on ShopQ belong to PulseCommerce Private Limited or their respective owners. You may not reproduce, distribute, or create derivative works without written permission.
12. Prohibited Conduct
You agree not to: manipulate bidding, create fake accounts, harass other users, circumvent platform fees, use automated tools to scrape data, or engage in any activity that disrupts the Platform.
13. Limitation of Liability
To the maximum extent permitted by law, ShopQ shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
14. Dispute Resolution
Any disputes shall be resolved through arbitration in Hyderabad, India, under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English.
15. Governing Law
These Terms are governed by the laws of India. Courts in Hyderabad, Telangana shall have exclusive jurisdiction.
16. Changes to Terms
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance. We will notify users of material changes via the app or email.
