Terms of Service

1. Acceptance of Terms
By accessing or using ShopQ ("the Platform"), operated by PULSECOMMERCE PRIVATE LIMITED ("we", "us", or "the Company"), a private limited company incorporated under the Companies Act, 2013, you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.
2. Eligibility
You must be at least 18 years old and capable of entering into a binding contract under Indian law. By using ShopQ, you represent that you meet these requirements.
3. Account Registration
You must provide a valid Indian mobile number to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.
4. Platform Services & Intermediary Status
ShopQ is a connecting platform that introduces buyers, sellers, service providers, and (where available) delivery partners to one another, and provides trust and verification rails — KYC, agreements/e-sign, ratings, and dispute facilitation.
ShopQ is an "intermediary" within the meaning of the Information Technology Act, 2000, and provides access to a communications/venue service. We are not a party to, and do not guarantee, any transaction between users. Contracts for goods or services are formed directly between the users; ShopQ does not own the goods/services, does not take title to them, and is not the seller, buyer, lender, or transporter. You transact with other users at your own discretion and risk, having verified them directly.
5. Listing and Selling
Sellers must provide accurate descriptions and images of items. Prohibited items include but are not limited to: illegal goods, counterfeit products, hazardous materials, weapons, and items that violate intellectual property rights. We reserve the right to remove any listing without notice.
Category compliance. ShopQ only enables a category in its lawful, compliant form. Where a category is lawful only subject to conditions, those conditions apply (for example: residential rentals via a properly executed/registered agreement; self-drive vehicle rental only with the applicable commercial permit). You are responsible for holding any licence, permit, or registration your listing requires. ShopQ does not enable, and you may not use the Platform to arrange, the non-compliant version of an otherwise-common activity.
6. Bidding and Auctions
Bids placed on the Platform are binding. The highest bidder at auction close is obligated to complete the purchase. ShopQ reserves the right to cancel auctions that violate our policies or where fraud is suspected.
7. Payments, Settlement & Fees
Money for the underlying goods or services is settled directly between users — typically peer-to-peer (for example via UPI) or offline. ShopQ does not operate an escrow, does not hold or take custody of your funds, and does not maintain a stored-value wallet on your behalf. Any balance or activity view in the app is an informational record only, not money held by ShopQ.
ShopQ earns revenue from services it provides — such as connection/unlock fees, verification fees, provider subscriptions, agreement generation, and promoted listings —not a commission on your peer-to-peer transaction. Any ShopQ service fee is shown to you before you incur it and is collected through our authorized payment partners (Razorpay, UPI via Juspay). ShopQ does not store your card or bank-account details.
8. Handover & Fulfilment
Handover of goods or performance of services is arranged directly between the users(self-pickup, in-person handover, or, where a connected delivery/rider network is available, an optional service the parties may choose to use). Estimated timelines are indicative and not guaranteed. ShopQ does not itself transport goods or perform the services, and is not responsible for their delivery, condition, or quality.
9. Disputes, Returns & Refunds
Returns, cancellations, and refunds are agreed and settled directly between the buyer and the seller/provider under whatever terms they set at the time of the deal. Because ShopQ does not hold funds, ShopQ does not process refunds and cannot guarantee any refund. 10. KYC and Verification
Partners, sellers, and riders must complete identity verification (KYC) as required. We use Aadhaar-based verification through a licensed KYC partner together with phone number validation; we do not store your raw Aadhaar number. Failure to complete KYC may result in account suspension.
11. Intellectual Property
All content, trademarks, and intellectual property on ShopQ belong to PULSECOMMERCE PRIVATE LIMITED or their respective owners. You may not reproduce, distribute, or create derivative works without written permission.
12. Prohibited Conduct
You agree not to: manipulate bidding, create fake accounts, harass other users, circumvent platform fees, use automated tools to scrape data, or engage in any activity that disrupts the Platform.
13. Limitation of Liability
To the maximum extent permitted by law, ShopQ shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the fees paid by you in the 12 months preceding the claim.
14. Dispute Resolution
Any disputes shall be resolved through arbitration in Hyderabad, India, under the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in English.
15. Governing Law
These Terms are governed by the laws of India. Courts in Hyderabad, Telangana shall have exclusive jurisdiction.
16. Changes to Terms
We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance. We will notify users of material changes via the app or email.
